End User License Agreement

1. License grant

Subject to this Agreement, Airway grants you a limited, revocable, non-exclusive, non-transferable license to install and use the Airway application for personal or internal business use. A standard paid personal license may be activated on up to two Macs. A student license may be activated on one Mac. Custom licenses are limited to the number of devices stated when issued.

Airway is licensed, not sold. You receive the right to use the software; ownership of Airway and its intellectual property does not transfer to you.

2. Restrictions

You may not:

• Share, resell, sublicense, rent, or transfer a license key except with prior written permission.
• Circumvent activation, device limits, trial limits, or other technical protections.
• Reverse engineer, decompile, or modify Airway except where applicable law expressly permits it.
• Use Airway to violate law, interfere with another system, or distribute malicious software.

3. Hardware control and your responsibility

Airway communicates with low-level macOS services and the System Management Controller through a privileged helper to read thermal data and request fan behavior. Changing fan behavior can affect temperature, noise, battery consumption, performance, and component wear.

You are solely responsible for deciding whether Airway is appropriate for your Mac, monitoring temperatures and system behavior, maintaining backups, and stopping use if you observe instability, overheating, unusual noise, or other unexpected behavior. Do not use Airway on unsupported, damaged, or safety-critical systems.

4. No refunds

All purchases are final and non-refundable. The free trial is provided so you can evaluate compatibility and functionality before purchasing. No refund, credit, or exchange is offered for mistaken purchases, incompatibility, discontinued use, device changes, or dissatisfaction. This policy does not exclude a refund or remedy that cannot legally be waived under applicable consumer law.

5. Support

Reasonable support may be provided by email for installation, activation, and ordinary troubleshooting. Support is provided on a best-efforts basis, without a guaranteed response time, resolution, service level, or obligation to support every Mac, macOS release, or third-party conflict. Providing support does not create a warranty or assumption of liability.

6. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRWAY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPATIBILITY, AND THAT AIRWAY WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

No statement in documentation, marketing, or support communication creates a warranty. Airway does not warrant that using the application will prevent overheating, throttling, data loss, component failure, or other damage.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRWAY'S DEVELOPER AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY DEVICE DAMAGE, HARDWARE FAILURE, OVERHEATING, DATA LOSS, LOST PROFITS, BUSINESS INTERRUPTION, PERSONAL INJURY, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO AIRWAY.

To the maximum extent permitted by law, total aggregate liability for all claims relating to Airway will not exceed the amount you paid for the license giving rise to the claim. Some jurisdictions do not permit certain exclusions, so these limits apply only to the extent lawful.

8. Trials, activation, and payments

Trial and license access may require an email address, license key, and device identifier. You are responsible for providing accurate information and protecting your license key. Payments are processed by the checkout provider shown at purchase. Its separate terms and privacy practices apply to payment processing.

9. Updates, availability, and termination

Airway may be updated, changed, suspended, or discontinued at any time. Continued compatibility with future macOS versions or hardware is not guaranteed. This Agreement terminates automatically if you materially breach it. On termination, you must stop using Airway and delete all copies in your possession.

10. Governing law and severability

This Agreement is governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles, except where mandatory local consumer law applies. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.

11. Changes and contact
